Company Policy

Terms of Trading

It is agreed that the Buyer will buy and the seller (hereinafter known as Defensor Security) will sell and both will abide by the terms of this agreement.

Terms of Payment

A 50% Deposit will be required prior to any installation work. Full balance due on completion. (Unless otherwise agreed by the company in writing).

Defensor Security cannot be held responsible for any delay in connection caused by other third parties such as British Telecom, Cable & Wireless or any other service provider. The goods supplied shall remain the property of the company until paid for in full. Non payment will entitle Defensor Security or their agents after giving notice to repossess to enter the premises and recover goods or products.

We shall be entitled to seek a court injunction to prevent you from selling, transferring or otherwise disposing of such goods. However, the risk in the goods will pass to you on delivery to you. You must insure them at replacement value and if asked you must produce evidence that they are properly insured.

Our Obligations

We agree to complete the installation to the relevant installation standard. Agreement will be sought from the customer should changes to the specification arise.

Every care will be taken in the installation of your Security System. Defensor Security will accept no liability for any damage, repair or replacement to the Buyer’s property, fixtures, fittings & furnishings during the process of the installation.

Supply services such as Gas/Water shall be identified to us by the Buyer where relevant.

When the equipment is commissioned the relevant staff will be trained in its operation. Repeated calls for staff training will be billed for at current callout rates.

Certificates of Conformity & all other completion paperwork will be handed over upon receipt of full payment.

A full 12 month warranty is offered against all equipment, this includes all labour & parts.

Any fault resulting from misuse or negligence by the customer or others, consumable items of all kinds failing such as batteries, damage from electrical equipment, mains spikes, lightning strikes & acts of God will not be covered under the agreement.

Except as may be implied by law where the customer is a consumer, in the event of any breach of these Conditions by us the remedies of the customer shall be limited to damages which shall in no circumstances exceed the price paid for the goods and or services. Force Majeure In the event that we are prevented from carrying out our obligations under a contract for sale as a result of any cause beyond our control such as but not limited to Acts of God, war, strikes, flood and failure of third parties to deliver goods, we shall be relieved of our obligations and liabilities under the terms and conditions for sale for as long as such fulfilment is prevented.

After the warranty period a maintenance contract may be offered to fully cover all equipment against failure.

Quotations offered are valid for 30 days. All quotations based on normal working hours of 8am to 5pm Monday to Friday. Out of hours working can be arranged by prior appointment.

Reasonable access to property will be required during the installation.

Complaints will be dealt with as soon as reasonably possible. A response will be made to the complainant within 48 hours.

Where the Company has a legal liability to the Buyer for the malfunction of the system due to the failure of the product supplied, installed, repaired or serviced to perform its intended function in such circumstances the Company's liability in respect of loss or damage to tangible property shall not exceed £1,000,000 (One million pounds). Where digital communicators are installed and connected to a central monitoring station via British Telecom, Cable & Wireless or other means of communication the Company cannot be held responsible for the failure of such means to transmit the signal. The transmitter chips in digital communicators, Red Care and Dual-Com units are programmed with the Company identification and therefore belong to the installing Company who reserve the right to recover them if monitoring ceases for whatever reason. The Buyer will indemnify the Company for any changes made to the Company by BT or Cable & Wireless or any other service provider for transmission of Alarm Signals also charges made by Red Care and/or Dual-Com and the designated monitoring station and charged to the installing Company on behalf of the Buyer.

The Buyer will be responsible for any charges made by the Police for Unique Reference Numbers (URNs) where the system is connected to a monitoring.

Customer Obligations

You agree to give Defensor Security full access to the premises to survey, install, test & service the equipment. Where relevant you agree to provide a stable electrical supply. Problems with access or an inadequate electrical supply may lead to further charges.

The customer will not interfere with or adjust any part of the equipment.

Any faults or problems need to be reported to us as soon as is practicable.

Any works which will affect the Security Systems operation need to be notified to us as soon as possible.

For monitored systems 2 months notice shall be given by the customer to cancel. Calls to site to default Engineering codes will be classed as callouts and charged accordingly.

Changes to the premises which affect the Security System must be notified to us.

You agree to permit the Company’s staff and representatives of its regulatory body (only whilst accompanied by the Company’s staff) access to the installation for the purposes of maintenance or inspection.

Liability

The Company does not know, and shall not be deemed to know, the true value of the Customer’s property or premises and is not the insurer thereof.

  • 1. Defensor Security shall not be liable for the costs of any work, repairs or replacement of Equipment which results from fire, electrical power surge, storm, flood, accident, neglect, misuse or malicious damage.
  • 2. Defensor Security has provided limited insurance cover for itself with indemnity for claims made against it in respect of accident, injury, loss or damage. Cover also extends to failure to perform and wrongful advice given unwittingly. A copy of the relevant insurance schedule is available to the Customer upon request.
  • 3. Although the Installation is designed to detect or deter intrusion and reduce the risk of loss or damage, Defensor Security does not represent or warrant that the installation may not be neutralised, circumvented or otherwise rendered ineffective by unauthorised persons and in such event Defensor Security shall not be liable for any loss or damage suffered by the Customer or other unauthorised persons. (Like all electronic equipment, the system could fail in rare and exceptional circumstances and Defensor Security cannot guarantee that it will be operational at any specific time or for any specific period. Defensor Security will explain what regular tests can be performed to verify that detection equipment is operational between routine maintenance visits carried out by the Company.
  • 4. The terms and conditions given in this contract do not affect your rights under the Sale of Goods Act or Unfair Contract Terms Act.

This Contract is governed by the laws of England and Wales, Scotland or Northern Ireland as the case may be and each party submits to the jurisdiction of the courts thereof.
